Acceptance of Terms

By accessing and using SimplePromo, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our service. These terms apply to all users of SimplePromo, including subscribers, visitors, and anyone who accesses the service.

Description of the Service

SimplePromo is a subscription-based service that provides weekly email newsletters containing curated promotion opportunities. Our service includes:

• Weekly email delivery of 20 to 30 handpicked promotion opportunities
• Access to micro influencer contacts, press opportunities, partnership leads, and other growth channels
• A personalized profile system to help us tailor opportunities to your preferences
• Access to member-only opportunities and cross-promotion with other SimplePromo members

We curate opportunities from various sources including influencer platforms, journalist request databases, startup communities, and growth marketing channels. Our goal is to save you time by providing actionable promotion opportunities in one convenient weekly email.

Eligibility and Accounts

To use SimplePromo, you must:

• Be at least 18 years old or have the legal capacity to enter into contracts in your jurisdiction
• Provide accurate, current, and complete information when creating your account
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

Each subscription is designed for one business or individual. If you are an agency managing multiple clients, you will need a separate subscription for each client account.

Subscriptions and Billing

Subscription Plans: SimplePromo operates on a monthly subscription basis. By subscribing, you agree to pay the monthly fee specified at the time of purchase.

Payment Processing: We use Stripe to process all subscription payments. By providing payment information, you authorize us to charge your payment method for the subscription fee on a recurring monthly basis. All payments are processed securely through Stripe's payment infrastructure.

Automatic Renewal: Your subscription will automatically renew each month unless you cancel before the renewal date. You will be charged the subscription fee on the same day of each month that you originally subscribed.

Cancellation: You may cancel your subscription at any time from your account page. When you cancel, your subscription will remain active until the end of your current billing period. You will continue to receive weekly emails until your subscription expires. No refunds will be provided for the current billing period, but you will not be charged for future periods.

Price Changes: We reserve the right to modify subscription prices at any time. If we change the price of your subscription, we will notify you in advance. Price changes will take effect at the start of your next billing cycle.

Failed Payments: If a payment fails, we may suspend or cancel your subscription until payment is successfully processed. We are not responsible for any service interruption due to failed payments.

Acceptable Use

You agree to use SimplePromo only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the service in any way that violates any applicable law or regulation
• Share your account credentials with others or allow unauthorized access to your account
• Resell, redistribute, or share the promotion opportunities with non-subscribers
• Use automated systems to scrape or extract data from our service
• Interfere with or disrupt the service or servers connected to the service
• Use the service to send spam, unsolicited messages, or engage in harassment
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Violate the rights of others, including intellectual property rights

No Guarantees of Results

SimplePromo provides curated promotion opportunities, but we do not guarantee any specific results from using these opportunities. The success of any promotion opportunity depends on many factors beyond our control, including the quality of your product or service, your outreach efforts, market conditions, and timing. We are not responsible for the outcomes of any opportunities you pursue, and we make no warranties about the quality, accuracy, or availability of the opportunities we provide.

Intellectual Property

The SimplePromo service, including all content, features, functionality, and design, is owned by SimplePromo and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of our service
• Use our trademarks, logos, or branding without permission
• Reverse engineer or attempt to extract the source code of our service
• Remove any copyright or proprietary notices from our content

You retain ownership of any content you provide to us, such as your profile information. By providing content, you grant us a license to use, store, and process that content to provide and improve our service.

Limitation of Liability

To the maximum extent permitted by law, SimplePromo and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the service.

Our total liability to you for any claims arising from or related to the service shall not exceed the amount you paid to us in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, if you breach these Terms of Service. Upon termination:

• Your right to use the service will immediately cease
• You will not be entitled to any refunds
• We may delete your account and associated data

You may terminate your account at any time by canceling your subscription and contacting us to request account deletion. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which SimplePromo operates, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the service shall be resolved in the appropriate courts of that jurisdiction.

Changes to These Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of SimplePromo after any changes constitutes your acceptance of the new terms. If you do not agree to the changes, you should cancel your subscription and stop using the service.
